Terms of Service — Rate My Server

1. Acceptance

By creating an account, following or endorsing a Pro, or otherwise using the Service, you agree to these Terms and to our Privacy Policy and Community & Content Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 17 years old to use the Service and able to form a binding contract. If you use the Service on behalf of an organization, you represent that you are authorized to bind it.

3. What the Service is

Rate My Server lets Guests follow and positively endorse hospitality professionals, and lets Pros build a portable profile ("living resume") of followers, endorsements, work history, specialties, and a Hospitality Score. The Service is built to be positive-only: there is no mechanism to post negative reviews, ratings, or complaints about a person.

4. Accounts and identity

  • Pros are responsible for the accuracy of their profile and for activity under their account. Choose a handle that represents you truthfully.
  • Guests provide a minimal identifier (phone, email, or Apple/Google sign-in) to make follows durable and to receive notifications.
  • Keep your credentials secure; notify us of any unauthorized use.

5. Acceptable use

You agree not to:

  • Impersonate any person or misrepresent your identity, role, or employment.
  • Create fake, purchased, incentivized, or automated endorsements or followers, or otherwise manipulate the Hospitality Score.
  • Use the Service to harass, threaten, or harm any person, on or off the platform.
  • Submit forged verification materials.
  • Scrape, harvest, or bulk-export data, or access the Service by automated means except as expressly permitted.
  • Interfere with the Service's security or operation, or use it to violate any law.

6. Your content and license

You retain ownership of the content you submit (profile details, photos, awards). You grant Rate My Pro a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute that content to operate and promote the Service (for example, rendering your public profile and link previews). Endorsements that Guests give are contributions to a Pro's profile; the resulting aggregate reputation is associated with the Pro and is portable with them across employers.

You represent that you have the rights to the content you submit and that it does not infringe others' rights.

7. Endorsements, scores, and verification are informational

Followers, endorsements, verification badges, and the Hospitality Score are provided for informational purposes. They are generated from user activity and may change, be recalculated, or be removed (for example, to address manipulation). We do not warrant their accuracy and they are not a guarantee of any person's skill, character, employment, or suitability for a role.

8. No employment or agency relationship

Rate My Pro is not an employer, staffing agency, or recruiter, and does not guarantee jobs, interviews, or hiring outcomes. Any future employer or recruiting features connect parties but do not make us a party to any employment relationship or hiring decision.

9. Fees

The Service is free for hospitality workers (Pros). We may offer paid features to employers, recruiters, or other businesses in the future; those will be governed by additional terms presented at purchase. Any payments will be handled by a third-party processor.

10. Intellectual property

The Service, including its software, design, and trademarks ("Rate My Server," "Rate My Pro"), is owned by Rate My Pro or its licensors and protected by law. We grant you a limited, revocable, non-transferable license to use the Service for its intended purpose.

11. Third-party services

The Service relies on third parties (e.g., authentication, push, hosting). We are not responsible for third-party services, and your use of them may be subject to their terms.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, RATE MY PRO WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF USD 100 OR THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM.

14. Indemnification

You will indemnify and hold harmless Rate My Pro from claims arising out of your content, your use of the Service, or your violation of these Terms or any law or third-party right.

15. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or the Community & Content Policy, or to protect the Service or its users. Sections that by their nature should survive (e.g., 6, 10, 12–14, 16) will survive termination.

16. Disputes and governing law

These Terms are governed by the laws of the State of South Carolina, without regard to conflict-of-laws rules. Any dispute relating to the Service will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, and you and Rate My Pro each waive any right to a class or representative action. You may opt out of arbitration by emailing legal@rate-myserver.com within 30 days of first accepting these Terms, and either party may instead bring a qualifying claim in small-claims court. Nothing limits rights that cannot be waived under applicable law. (This dispute-resolution section is pending final review by counsel.)

17. Changes

We may update these Terms. We will post the new effective date and, for material changes, provide additional notice. Continued use means you accept the updated Terms.
